1. Designations
In these general sales terms, the following terminologies will have the following meanings:
Customer: indicates the customer, whether consumer or not, who purchases one or more Products. The customer must be of age.
Conditions: indicates these general sales conditions;
Contract: indicates the contract concluded by acceptance of the proposal by Auramat®.
AURAMAT®: indicates the brand of SIMONE RIPAMONTI, based in Sassari – | tel. +39.3484715356
Products: generally refers to products marketed by the Auramat® brand.
Proposal: indicates each proposal for advanced purchase by the Customer following the purchase procedure on the Site.
Site: indirectly indicates the site https://www.auramat.it
2. Scope
These Terms and Conditions apply to all Sales Contracts relating to the Products, as well as to Service Contracts concluded between AURAMAT® and the Customer following acceptance of the Proposal submitted by the Customer by AURAMAT®, being understood between the Parties to the sales contracts of the Products.
AURAMAT® AURAMAT reserves the right to modify and/or integrate, in whole or in part, these Terms at any time; in that case, the modifications and/or additions made will apply to all Proposals, and the related Contracts, sent after the publication of the new Terms on the Site.
3. Subject of the Contract – Consideration
The sale only includes the Products and the related quantities and prices specified in the Proposal sent by the Customer and accepted by AURAMAT®.
The sales prices of the Products – present on the Site of each Product – will be indicated in the Proposal and, unless otherwise agreed by the Parties, are understood to include VAT and net of packaging and transport charges (which in any case, if provided by the Customer, they will find quantification on the Site page for the Proposal Product).
4. Invitation to Offer – Proposal – conclusion of the Contract
The publication of the Products and/or the Services on the Site constitutes only an invitation addressed to users to formulate a Proposal. The Summary page of the Site and/or the Catalogue contains all pre-contractual and contractual information necessary for the Customer to be suitably informed about their rights and obligations.
The submission of the Proposal in the forms provided by the Site and assuming the explicit acceptance of these Terms is transmitted by the Customer to AURAMAT® through the procedure that the Customer is required to follow as indicated on the Site.
Without prejudice to AURAMAT®’s right to refuse the Proposal, the Agreement will be deemed terminated when AURAMAT® has sent via email the written acceptance of the Proposal.
5. Payment
The Customer, following the procedure outlined on the Site, will be able to choose how to execute the Contract payments: PayPal or Credit Card.
6. Transport conditions – Place and delivery time
Delivery of the Products will take place at the address provided by the Customer in the Proposal. The delivery terms indicated on the Site and/or the acceptance of the Proposal are purely indicative: AURAMAT® does not guarantee compliance with the delivery terms indicated therein, apart from the obligation for AURAMAT® itself to deliver, if the product is not available within the warehouse, not later than 30 days after the conclusion of the Contract.
7. Withdrawal
Customer may withdraw only from Contracts for Products not used after delivery, without specifying the reason and at no additional cost, except for the shipping costs for returning the Product.
In order to terminate the Contracts, the Customer must send a document in writing to AURAMAT® to request the withdrawal, appropriately completed and signed with autographed signature no later than 14 (fourteen) days after receipt of the Product. The return of the Product to be withdrawn must be made within 14 (fourteen) days of the return of the notice of withdrawal, and the Customer’s expenses at the address of AURAMAT®.
The Customer shall also be obliged to return the Products in the state in which they received them, without alteration and/or manipulation (including packaging) of the Products themselves.
AURAMAT® will refund the amounts paid by the Customer within 30 (thirty) days of receipt of the notice of the withdrawal, except in any case the right of AURAMAT® to withhold the amounts until it has received the Products or until the Customer has demonstrated to have them shipped.
8. Processing of personal data
AURAMAT® undertakes to treat the personal data of the Customer in accordance with the applicable law, and in any case will treat the data in digital and paper form with the purpose of disbursing the order of the Customer’s requested Products. The data will not be in any way communicated or disclosed to third parties. The data controller is – AURAMAT® -.
For statistical purposes, this website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files that are stored on your computer to allow the website to analyse how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and Internet usage. Google may also transfer this information to third parties where required to do so by law or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google. You may refuse to use cookies by selecting the appropriate settings on your browser, but this may prevent you from using all the features of this website. By using this website, you consent to the processing of your data by Google in the manner and for the purposes set out above.
9. Applicable Law – Jurisdiction
The Contract between AURAMAT® and the Customer is governed by Italian law. Any dispute should arise between AURAMAT® and the Customer with reference to the Contract will be subject to the jurisdiction of the Italian court and will in any case be referred to the mandatory jurisdiction of the Court of Sassari.
